John J. Checkett of the Checkett Law Firm, PLLC, secured a complete defense award after a multi-day binding arbitration hearing (Taylor v. Maravilla Care Center, et al., CV2013-004095).
Plaintiff brought claims of negligence, violation of the Arizona Adult Protective Services Act, A.R.S. 46-451 et seq. and sought punitive damages against an Arizona licensed skilled nursing facility related to the 7+ year admission of a catastrophically brain injured and bed bound Plaintiff who developed a chronic non-healing Stage IV pressure wound which required multiple surgical flap closures.
Plaintiff’s lowest demand before arbitration was $1M dollars. After a four-day binding arbitration hearing, retired Judge/ appointed arbitrator found in favor of Defendants on all claims.
